The construction industry has been an important contributor to the Malaysian economy. However, late payment or non-payment remain chronic issues that affecting the entire delivery chain of construction industry. To counter this issue, Construction Industry Payment and Adjudication Act (CIPAA) was gazetted by the Government in June 2012 and came into force two years after with the objective “to facilitate regular and timely payment, to provide a mechanism for speedy dispute resolution through adjudication, to provide remedies for the recovery of payment in the construction industry and to provide for connected and incidental matters”.
In a recent report published by Asian International Arbitration Centre (AIAC), there has been a significant increase in adjudication matters over the past 4 years after CIPAA was introduced. Based on the latest statistics, a total of 711 adjudication matters were reported in the calendar year 2017, up from 463 in the year 2016.
Four years down the road, has CIPAA achieve its initial objective? With the recent change in the Malaysia Government, a major reform is made. What are then the changes and opportunities in construction industry? What are the landmark cases decided under CIPAA? Did CIPAA change the entire landscape of construction dispute resolution?
